These Terms are a working draft. They have not been reviewed by counsel and are not yet binding. We're publishing the draft here for transparency and feedback during the onboarding wave. The final, binding Terms will replace this page when published; we'll notify active owners before that happens.

Terms of Service (Owner) ​

These Terms govern your use of the Trucked Up platform as a truck owner — that is, an account holder whose Cognito group includes owner and whose account has been linked to a listed food truck.

1. Eligibility ​

You may use Trucked Up as an owner if:

  • You are at least 18 years old.
  • You are legally authorized to operate the truck whose listing is connected to your account, including holding any required permits, licenses, and insurance under Florida and West Palm Beach municipal law.
  • The information you provide to Trucked Up (truck name, address, contact info, menu, photos) is accurate and you have the right to publish it.

2. Your account ​

You are responsible for everything that happens through your account, including actions taken by anyone you've shared your credentials with. You agree to keep your account details current — particularly your truck profile, schedule, and contact email.

If you suspect your account has been accessed by someone else without your authorization, email us immediately.

3. Your truck listing ​

You are responsible for keeping your listing reasonably accurate, including:

  • Your truck profile (name, cuisine, description, contact info, photos).
  • Your schedule of upcoming stops.
  • Your menu items and prices.
  • The fulfillment details (pickup address, delivery radius if delivery is enabled).

Listings that are repeatedly out-of-date, inaccurate, or misleading may be flagged or hidden from the public map at our discretion.

4. Orders you accept ​

When a customer places a pickup or delivery order through your truck and you accept it (by tapping Start (enter ETA)), you agree to:

  • Make a good-faith effort to prepare and fulfill the order within the ETA you set.
  • Either fulfill or cancel + refund the order before marking it Complete.
  • For delivery orders: hand the prepared order to the assigned DoorDash dasher in a reasonable time window.

5. Booking inquiries (leads) ​

When a customer submits a booking inquiry, you can choose whether to validate it (unlocking their email and phone) or decline it. Validating a lead costs $15 per the Refund Policy and triggers an immediate fee. Declining is free.

You agree to use customer contact info only to discuss the inquiry on the platform. You may not add unlocked customer contact info to marketing lists, share it with third parties, or use it for any purpose other than responding to the specific inquiry.

6. Fees and payouts ​

The Trucked Up business model is performance-based — you only pay us when we generate value for you.

  • Free to list. No setup fee, no monthly fee.
  • Pickup orders: Trucked Up takes a small commission on the order subtotal. The exact rate is published on the Refund Policy page and reflected in your payout.
  • Delivery orders: Trucked Up bills DoorDash dasher fees through the customer's checkout, not your subtotal. Your subtotal commission rate is the same as for pickup.
  • Booking inquiries: $15 per validated lead.
  • Refunds: see the Refund Policy for the full list of refund and chargeback rules.

Payouts are issued via Stripe Connect on a schedule we'll publish in your owner dashboard. You're responsible for keeping your Stripe Connect account in good standing.

7. Content rights ​

  • You retain ownership of the photos, videos, descriptions, and menu content you upload.
  • You grant Trucked Up a non-exclusive, royalty-free, worldwide license to host, store, reproduce, modify (e.g., resize and transcode), publicly display, and distribute that content as part of operating the platform — including showing it on truck pages, the map, social previews, and marketing materials about the platform.
  • You confirm you have the rights to grant that license (i.e., the photos/videos are yours or properly licensed; the descriptions don't infringe anyone else's copyright).
  • You may remove content at any time by deleting it from your profile. Deleted content is removed from public surfaces within minutes; backups may persist for up to 90 days for operational reasons.

8. Acceptable use ​

You agree not to use Trucked Up to:

  • List items or services that are illegal under Florida or US law.
  • Misrepresent your truck (e.g., listing under a name that misleads customers about who they're buying from).
  • Harass, threaten, or discriminate against customers, dashers, or other owners.
  • Spam customers via broadcasts, email, or any other channel reachable through the platform.
  • Abuse the lead validation system (e.g., validating leads with no intent to follow up; misusing customer contact info).
  • Reverse-engineer, scrape, or otherwise interfere with the platform's operation.

9. Suspension and termination ​

We may suspend or terminate your owner access if you materially violate these Terms or our Content Guidelines. We'll typically notify you first and give you a reasonable opportunity to cure, except in cases of urgent safety, legal, or platform-integrity issues.

You may terminate your owner account at any time by emailing us. Termination doesn't affect already-accepted orders or already-validated leads — you remain responsible for those.

10. Disclaimers ​

Trucked Up is a platform connecting customers and trucks. We don't cook the food, drive the delivery vehicles, or guarantee any particular volume of orders or leads. Trucked Up is provided "as is" and we make no warranty that the platform will be uninterrupted or error-free.

11. Limitation of liability ​

[Lawyer review required. This section will contain the platform's standard limitation-of-liability and indemnification clauses, drafted to comply with Florida law and to align with our insurance coverage. The current draft is intentionally blank pending counsel input.]

12. Governing law ​

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Disputes will be brought exclusively in state or federal courts located in Palm Beach County, Florida.

13. Changes to these Terms ​

We may update these Terms over time. Material changes will be communicated via email and an in-app notice at least 14 days before they take effect. Continued use of Trucked Up after the effective date of an update constitutes acceptance.
